This Terms & Conditions set forth the conditions on which we will provide the services offered through the wifieggkorea.com website. This Terms & Conditions is a contract between you (“Customer”) and WiFi Korea (“We” or “Company”), and covers all rentals made pursuant to this Website.
BEFORE YOU CLICK ON THE “Pay with Paypal” BUTTON, PLEASE CAREFULLY READ THE TERMS AND CONDITIONS SET FORTH HEREUNDER. BY CLICKING ON THE “I accept the Terms & Conditions” CHECKBOX, YOU ARE BOUND BY AND HAVE BECOME A PARTY TO THIS AGREEMENT.
1. Nature of services
Company provides a wireless modem rental service (the “WiFi Egg”), along with accessories (collectively the “Equipment”) to travelers who plan to visit South Korea from abroad. We do not offer Equipment for sale on this Website.
2. Use of equipment
When you place an order to rent the WiFi Egg, we will ask for your Arrival and Departure Date. The Equipment will then be picked up by you at Incheon or Gimhae Airport, or your accommodation in Korea. It is your responsibility to inspect all Equipment upon receipt and to verify that it is in good working order and condition. It is your responsibility to ensure that you are available to pick up our Equipment on your Arrival Date as indicated on the online booking form.
All Equipment should be returned in person to the Company’s pickup & return counter at Incheon or Gimhae Airport in Korea. The Equipment shall be returned in good working order and condition. You assume all risk of loss and damage from the return of all Equipment.
4. Fees and charges
(a) Rental Fees
Rental fees for the use of our Equipment are assessed commencing as of the Pick-up Date and ending as of the date on which the Equipment is returned. Our current rental fee schedule is posted on our Website and may be amended from time to time upon prior notice. To place any booking, we require you to make a payment of the anticipated charges and a deposit of US$50. Deposit will be returned via PayPal within 24-48 hours after you’ve returned the device.
(b) Charges for Damage or loss of the Equipment
We will bill charges for damage or loss of the equipment and apply them toward the deposit. A fee of US$50 will be levied upon the customer in the event of loss of each WiFi Egg modem rented. Company will not accept replacement devices as a substitute for any of these fees.
(c) Late Fees. Failure to return the Equipment promptly to us will result in the incurrence of additional late charges. All returns must be made on or before your Return Date. In the event that we fail to receive the Equipment, or any portion of the Equipment after the rental end date, you will be incur a daily penalty fee of US$5 until the date the Equipment is received. In case the equipment is not returned within 10 working days of your Return Date you will incur a final penalty fee for the loss of the equipment.
If for any reason you need to cancel your booking, you can do so without penalty before your rental date starts. After your rental date starts, we will charge a cancellation fee of US$10.00. The rental fees for the period you had the device will be exempt from the refund. You will need to return the device to us on the day that you cancel your order – days where you are in possession of the device cannot be refunded. If the device is returned by postal service due to cancellation, then the postage fee may be charged to the customer.
6. Ownership of equipment
By using this service, you agree and acknowledge you are renting Equipment for travel purposes only, and that you will acquire no rights in the Equipment.
7. Policy for fair usage of data communication
When the mobile network provider in Korea identifies a massive volume of data communication, the communication volume for the line may be limited without prior notice in order to maintain network quality and fair usage of radio waves. For this reason, internet connection may be lost or the communication speed may decrease.
In the event of usage restriction to mobile communication devices, etc. due to the reason above, the Company shall take no responsibility and the customer shall pay the usage fees, etc. to the Company.
8. Dispute resolution
The parties agree that this Rental Agreement will be governed by South Korean law and all disputes shall be filed and proceeded according to South Korean legal system.
9. Rental period
The Rental Period commences on your pickup date (“Pickup Date”) and expires upon your designated return date (“Return Date”).
